Privacy Policy

This Privacy Policy explains how Nieko Xavier Wadley, an individual doing business as Xaviers Reviews (“Xaviers Reviews,” “we,” “us,” or “our”), collects, uses, discloses, retains, and otherwise handles personal information in connection with the Xaviers Reviews website, platform, accounts, public professional profiles, reviews, subscriptions, search and save features, and related services (collectively, the “Service”). Xaviers Reviews currently operates as a trade name, not as a separate limited liability company or corporation.

This Policy applies to the current Xaviers Reviews service and is structured to accommodate features such as advertising, sponsored placements, and a future hospitality-industry job board. As the Service changes, this Policy may be updated to describe material changes in data practices as required by applicable law.

Important distinction between public and nonpublic information.

Professional profiles, reviews, ratings, profile photographs, workplace information, professional roles, taglines, XR numbers, and other information a user chooses or is permitted to publish may be visible to the public. Account credentials, payment details handled by payment processors, and other information not designated for public display are treated differently as described below.

1. Scope and Applicability

1.1 Covered Services. This Policy applies to personal information handled by Xaviers Reviews through the Service and through related communications, support, subscription administration, review moderation, and platform operations.

1.2 Third Parties. This Policy does not govern independent websites, applications, payment processors, advertisers, or other third parties that control their own data practices. Their privacy notices apply to information they collect directly from you or otherwise process as independent controllers or businesses.

1.3 Changes in Functionality and Providers. We may add or replace service providers and change technical tools as the Service develops. A change in provider does not authorize an undisclosed use of personal information or override your privacy choices. If a change materially affects the categories of information collected, its uses, its recipients, or your rights, we will update this Policy and provide any additional notice or obtain any consent required by applicable law before implementing the change.

2. Personal Information We Collect

The information involved depends on how you interact with the Service, the features you use, and the technologies enabled for those features. The categories below describe information used in providing the Service. References to optional or future features apply only when those features are made available and the described processing occurs; they do not mean every listed technology is currently in use.

3. Sources of Personal Information

We may collect personal information from the following sources, depending on how the Service operates and which features you use:

  • directly from you when you register, create or manage a profile, submit a review, purchase a membership, contact support, report content, or otherwise use the Service;
  • from other users when they submit reviews, ratings, reports, or other user-generated content concerning a professional or interaction;
  • from payment processors such as Stripe in the form of transaction, subscription, payment-status, or limited billing information needed to administer a membership;
  • automatically from devices, browsers, cookies, logs, security systems, or analytics technologies to the extent those technologies are implemented; and
  • from service providers or other lawful sources when necessary to operate, secure, support, or maintain the Service.

The categories of providers used to operate the Service may change over time. We will describe material data practices and provide additional notice or choices when required by applicable law.

4. Public Profiles, Reviews, and User-Generated Content

4.1 Public Information. Information displayed on a professional profile or submitted as a public review is public information. Depending on the feature, this may include a name or display name, profile photograph, workplace, role, ZIP code or general location, tagline, XR number, ratings, reviews, and other information the Service designates for public display.

4.2 Search and Sharing. Public profile information and reviews may appear in searches, saved-professional lists, profile pages, rankings or sorting features, internal recommendations, or other public-facing parts of the Service. Other users may copy, share, screenshot, or otherwise use public information outside our control. If a Professional no longer has paid or complimentary membership access, the Professional may continue to appear in search results with a “Not Active” designation, while the full Professional profile is unavailable and new reviews and new Favorites are blocked until eligible membership access is restored.

4.3 Review Authors. Reviews may contain information about the reviewer’s experience and about the professional being reviewed. Reviewers should avoid posting unnecessary personal information about themselves or others, including sensitive contact details, financial information, medical information, private communications, or other information not reasonably relevant to the review.

4.4 Moderation and Copyright Records. If you report or dispute content, we may collect your contact details, supporting documents, correspondence, and records reasonably necessary to evaluate the issue, prevent abuse, respond to legal claims, or maintain platform integrity. Copyright notices and counter-notices may be shared with the affected parties, including contact information reasonably necessary to administer the process described in Section 18 of the Terms and Conditions.

5. Payments and Stripe

Stripe is responsible for securely processing and retaining the underlying payment-card information used for subscription payments and refunds for Xaviers Reviews. Xaviers Reviews does not store users' full payment-card details. Depending on the payment method and interface, Stripe may process payment-card, bank, billing, device, fraud-prevention, and transaction information under its own privacy practices.

Xaviers Reviews maintains only the limited subscription, transaction, billing, payment, and refund-related information made available by Stripe that is reasonably necessary to identify and manage membership or subscription status, payments, refunds, and related Service functionality. When you request a refund, we use relevant account and transaction information and your correspondence to identify the payment and arrange a refund through Stripe to the original payment method, as described in the Terms and Conditions. Do not send passwords or full payment-card details by email or include them in public content.

Payment information may also be used for fraud prevention, accounting, tax, dispute, chargeback, and legal-compliance purposes as permitted by law.

6. Cookies, Device Information, and Analytics

6.1 Cookies and Similar Technologies. The Service may use cookies, local storage, pixels, software-development tools, log files, or similar technologies for authentication, session management, preferences, security, analytics, performance, fraud prevention, or advertising when those functions are enabled.

6.2 Categories. Technologies used for the Service may include strictly necessary or functional technologies needed to operate accounts and security features, analytics technologies used to understand Service usage, and advertising technologies if advertising is implemented. Some technologies may be set by third-party service providers.

6.3 Choices. Browser or device settings may allow you to block or delete cookies, but doing so may affect functionality. If applicable law requires consent, an opt-out, or recognition of an opt-out preference signal for a particular tracking practice, Xaviers Reviews will provide or honor the required mechanism.

6.4 Do Not Track and Preference Signals. Because there is no single uniform industry standard for legacy browser “Do Not Track” signals, the Service may not respond to them. Where a legally recognized opt-out preference signal, such as Global Privacy Control, must be honored for a covered practice, Xaviers Reviews will process the signal as required by applicable law.

7. How We Use Personal Information

We may use personal information for the following business and operational purposes, as applicable to the Service:

  • provide, maintain, and administer accounts, professional profiles, reviews, ratings, search, saved-professional features, memberships, and other Service functionality;
  • process subscription payments and manage billing, renewals, cancellations, refunds, chargebacks, and complimentary memberships;
  • authenticate users, maintain sessions, prevent unauthorized access, and protect account security;
  • display public professional profiles and public user-generated content and make them searchable within the Service;
  • moderate reviews, investigate reports, address disputes, detect fake or manipulated reviews, and enforce the Terms and Conditions;
  • respond to support requests, account questions, legal notices, privacy requests, and other communications;
  • detect, investigate, and prevent fraud, abuse, harassment, scraping, security incidents, and violations of law or policy;
  • measure performance, troubleshoot, conduct analytics, understand usage, and improve the Service and user experience;
  • develop and operate advertising, sponsored content, or job-board features if and when implemented, subject to applicable notices and choices;
  • comply with legal obligations, enforce rights, respond to lawful process, protect safety, and establish, exercise, or defend legal claims; and
  • carry out other purposes disclosed to you at collection or with your consent where required.

8. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Policy:

8.1 Service Providers and Processors.

We may disclose information to vendors supporting hosting, infrastructure, database or cloud storage, authentication, communications, analytics, security, fraud prevention, payment processing, customer support, or other functions used to operate the Service. Disclosures are limited to information reasonably necessary for the relevant function and remain subject to applicable contractual and legal restrictions. The providers and tools may change without changing the purposes described in this Policy. Advertising partners acting for their own purposes are addressed separately in Sections 8.4 and 9.

8.2 Stripe and Payment Ecosystem Participants.

Payment and transaction information may be disclosed to or collected by Stripe, card networks, banks, payment partners, fraud-prevention providers, and other entities involved in processing or resolving transactions.

8.3 Public and Other Users.

Public professional-profile information, reviews, ratings, and other public user-generated content are disclosed to users and the public through the Service. Information included in a review may also be visible to the professional being reviewed.

8.4 Advertising and Marketing Partners.

If advertising, sponsored content, or campaign measurement is implemented, we may disclose or make available device, usage, cookie, advertising-interaction, or similar information to advertising or measurement partners as described at the time and subject to legally required choices.

8.5 Professional Advisers and Corporate Transactions.

We may disclose information to attorneys, accountants, auditors, insurers, financing sources, and other professional advisers where reasonably necessary. Information may also be disclosed in connection with a merger, financing, acquisition, bankruptcy, reorganization, sale of assets, or similar transaction, subject to applicable law.

8.6 Legal, Safety, and Compliance Disclosures.

We may disclose information if we reasonably believe disclosure is required by law, subpoena, court order, or lawful governmental request; is necessary to investigate fraud or security incidents; is appropriate to enforce agreements or protect rights; or is reasonably necessary to protect users, Xaviers Reviews, or the public from harm.

8.7 At Your Direction or With Consent.

We may disclose information when you direct us to do so or provide consent, including when a feature is designed to share information with another person or service.

9. Advertising, “sale,” “sharing,” and Targeted Advertising

Xaviers Reviews may support advertising opportunities, including advertising on search results, the homepage, or other areas of the Service. If advertising technologies are implemented, certain disclosures of identifiers, device data, cookie data, or activity information could be treated as a “sale,” “sharing,” or use for targeted advertising under some U.S. state privacy laws even when no money is exchanged for the personal information.

Where applicable law grants a right to opt out of sale, sharing, or targeted advertising, Xaviers Reviews will provide an appropriate method to exercise that right and honor legally recognized preference signals when required. Before enabling a practice requiring additional disclosure, consent, or an opt-out, we will provide the required notice and mechanism. General references to advertising in this Policy do not replace those obligations.

Xaviers Reviews will not knowingly use sensitive personal information for targeted advertising or another restricted purpose in a manner prohibited by applicable law.

10. Communications

10.1 Service Communications. We may send account verification, password, security, subscription, billing, cancellation, policy, moderation, support, or other service-related communications using contact information associated with your account.

10.2 Marketing Email. Xaviers Reviews does not currently plan to send promotional or marketing email communications. If marketing email is introduced later, you may opt out using the unsubscribe mechanism in the message or another method we provide. Opting out of marketing will not prevent necessary service or transactional communications.

10.3 SMS and Automated Calls. Xaviers Reviews does not currently plan to use SMS or automated telephone communications for the initial launch. If that changes, Xaviers Reviews will update its disclosures and obtain any consent required by applicable law before sending regulated messages.

11. Data Retention

Xaviers Reviews retains personal information for no longer than reasonably necessary for the purposes for which it was collected or another legitimate and lawful purpose. Retention may depend on account or membership status, the nature of public user-generated content, subscription and accounting obligations, fraud-prevention and harassment-prevention needs, dispute or litigation holds, security records, backup cycles, statutory requirements, and the need to enforce agreements or protect legal rights.

Retention periods vary by category of information and operational need, so Xaviers Reviews does not apply one fixed retention period to all personal information. If a Professional loses paid or complimentary membership access, the account and associated information remain in the system while the Professional profile is marked Not Active. Existing Favorites, the XR number, profile information, reviews, subscription or invoice records maintained by the Service, and account or login information remain associated with the account unless later removed or restricted in accordance with this Policy or applicable law. Existing reviews remain in the system, and a Favorite created before the Professional became inactive may remain visible to the User who previously saved it.

The Service does not currently offer a self-service account deletion feature or routine account deletion through the Admin Panel. A verified privacy request may nevertheless require Xaviers Reviews to delete, restrict, de-identify, or otherwise act on personal information under applicable law. Xaviers Reviews may use available administrative or technical methods, including assistance from its service providers, to process such requests when required. A privacy deletion request does not necessarily require removal of every public review or other content where retention is permitted by law, including where reasonably necessary to protect rights, prevent fraud or harassment, preserve platform integrity, comply with legal obligations, or maintain evidence of disputes or misuse.

12. Access, Correction, Review Controls, and Privacy Requests

A User may edit or delete a review they submitted through the available user-facing functionality for twenty-four (24) hours after submission. After the 24-hour period expires, the review is locked and cannot be edited or deleted by the User through the normal platform functionality, although Xaviers Reviews may still moderate, restrict, remove, restore, or preserve content under the Terms and Conditions, applicable law, or a valid legal or privacy request. Professionals do not currently have a separate account-deactivation feature. If a Professional cancels or loses paid or complimentary membership access, the account remains in the system and the Professional profile becomes Not Active as described in Section 11. The Service does not currently provide self-service account deletion or a self-service data-export tool.

You may contact us using Section 21 to request access, correction, deletion, a copy of information, restriction, or another action concerning personal information. The absence of a self-service account-deletion or data-export feature does not limit rights provided by applicable law. We may take reasonable steps to verify identity or authority before acting on a request, including requiring you to authenticate through your account or provide information reasonably necessary to confirm the request. Where applicable law requires deletion, restriction, or another action, Xaviers Reviews will take reasonable steps to process the verified request using available administrative or technical methods, subject to lawful exceptions. We may deny or limit a request where permitted or required by law, including where we cannot reasonably verify the requester, where retention is required for legal or security reasons, where the information concerns another person, or where an exception applies. We will not discriminate against a person for exercising privacy rights protected by applicable law.

If you use an authorized agent to submit a request, we may request proof of the agent’s authority and may still need to verify your identity directly where permitted.

13. U.S. State Privacy Rights

Depending on where you live and whether a particular state privacy law applies to Xaviers Reviews, you may have rights concerning your personal information. These rights may include the right to:

  • confirm whether we process personal information and obtain access to or a copy of it;
  • correct inaccuracies in personal information;
  • request deletion of personal information, subject to exceptions;
  • obtain a portable copy of certain personal information;
  • opt out of sale, sharing, targeted advertising, or certain profiling where applicable;
  • limit certain uses or disclosures of sensitive personal information where applicable;
  • appeal a denial of a privacy request where applicable; and
  • exercise protected rights without unlawful discrimination or retaliation.

The availability and scope of rights vary by state and may depend on whether Xaviers Reviews meets statutory applicability thresholds. We may voluntarily honor a request even when not legally required, but doing so does not mean a particular statute applies to Xaviers Reviews.

14. California Privacy Disclosures

If the California Consumer Privacy Act, as amended (“CCPA”), applies to Xaviers Reviews, California residents may have rights to know, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and be free from discrimination for exercising covered rights. Whether the CCPA applies depends on statutory criteria, including business activities and threshold requirements.

The categories of personal information described in Section 2, the sources described in Section 3, the purposes in Section 7, and the categories of recipients in Section 8 provide an account of the Service’s current and reasonably anticipated data practices. If and to the extent the CCPA applies, Xaviers Reviews will provide any additional notice-at-collection, request methods, opt-out mechanisms, Global Privacy Control recognition, retention disclosures, or other measures required by applicable law.

California law may also require disclosure regarding online tracking and browser signals. As described above, the Service may not respond to legacy Do Not Track signals, but legally recognized opt-out preference signals will be honored when applicable.

15. Children’s Privacy

The Service is intended only for persons who are at least eighteen (18) years old. Xaviers Reviews does not knowingly permit persons under 18 to create accounts or use account-based features. If we learn that personal information has been collected through an account created by a person under 18 in violation of this age restriction, we will take reasonable steps to delete or restrict the information as appropriate, subject to applicable law and any lawful need to retain limited records. If the Service later permits minors to use any feature, Xaviers Reviews will update its age, consent, and privacy practices as required by applicable law.

16. Data Security

Xaviers Reviews uses or will use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, acquisition, loss, misuse, alteration, or disclosure, taking into account the nature of the information and the Service. No online service, transmission method, or storage system can be guaranteed to be completely secure.

Users are responsible for protecting account credentials and should notify Xaviers Reviews of suspected unauthorized access. We may change the technical and organizational tools used to protect the Service as technology, risks, and operational needs evolve.

17. International Processing

Xaviers Reviews is intended primarily for the United States at launch. Some service providers may operate infrastructure or personnel in multiple jurisdictions. Personal information therefore may be processed in a state or country different from the one in which it was collected, where different data-protection laws may apply. Where applicable law requires safeguards for such processing, Xaviers Reviews will implement the required measures.

18. Third-Party Websites and Services

The Service may link to or integrate with third-party websites or services. Xaviers Reviews is not responsible for the privacy practices of an independent third party. You should review the privacy notice of any third party before providing personal information directly to it.

The initial Service does not include a specific social-media login, sharing integration, or embedded social-media feature. If such functionality is introduced and materially changes data practices, this Policy will be updated as appropriate.

19. Future Job Board, Business Accounts, and New Features

If Xaviers Reviews introduces a hospitality job board, employer or business accounts, candidate discovery, expanded advertising, or another feature that materially changes data collection or use, we may collect additional business, employment, application, communication, or advertising information. Before such a feature becomes operational, Xaviers Reviews will provide any supplemental privacy disclosure or consent required by applicable law and will update this Policy if the change is material.

Xaviers Reviews does not currently conduct employment screening or automated employment decision-making through the Service, and the initial Service does not use third-party artificial-intelligence or automated content-moderation services. If those practices materially change, we will update relevant disclosures as required.

20. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Service, technology, law, or business practices. We will post the updated Policy with a revised effective date and provide additional notice or obtain consent when required by applicable law. Material changes will not be applied retroactively in a manner prohibited by law.
